TERMS OF SERVICE

GENERAL TERMS

  1. I have the right to reject clients if I find the design offensive to any specific individuals/ groups or I am uncomfortable with it.

  2. Depending on the type of commission, a watermark may be included discreetly in the drawing that should not be removed.

  3. TOS and prices may be changed without prior notice.

  4. If the client breaks any of the mentioned points in the TOS/ agreed terms stated in the invoice, I will have the right to profit further from the commissioned artwork in any way.

  5. I claim the rights to all works under 'Rowen Pumpkin', 'RoweenVT' and 'RoweenTako'

PAYMENT

  1. All prices listed are in USD.

  2. Payments are only to be made through Paypal.

  3. Commissions are to be paid 100% upfront*.

  4. Please do not make payment until I have sent you an invoice and asked you to do so.

  5. By making payment, it is assumed that the client agrees with all terms that are included in the TOS and/ or stated in the invoice sent to them

*Commissions $500 and above can be made in 2 parts, 50% upfront and 50% after completion.

PROCESS AND DELIVERY

  1. Progress of the commission will be updated in stages as I complete them.

  2. Update frequency depends on the type and complexity of the commission.

  3. Delivery time depends on the type and complexity of the commission. Please refer to your invoice for the turnaround time.

  4. You will be notified ASAP if there will be a delay in the turnaround.

  5. Please refer to your invoice for the file type you will receive for your commission.

REVISIONS

  1. No design changes are to be requested after the final product has been handed over. Only technical revisions are allowed at this point (eg. Image size, file format, etc)

  2. Changes after the end of the commission will require a fee of 20% - 50% of the price of the commission to be paid depending on the size and degree of change.

COPYRIGHT / USAGE POLICY
As the artist, I claim the rights to the produced artwork. Therefore, I am allowed to use the artwork in the following ways:

  • Carry out self-promotions

  • Publish into physical products

  • Post the work on my social media/ websites

As the client, you will be allowed to use the artwork in the following ways:

  • For personal use (uploading it on your social media/ websites for non-commercial purposes)

  • Print the art for personal use

  • Claim the characters but not the artwork itself

The following is considered copyright infringement:

  • Reproducing/using the copyrighted artwork commercially - making money off it in any way.

  • Claiming the artwork as your own

  • Removing my watermark from the artwork

  • Altering the artwork without my consent

I reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).

REFUND / CANCELLATION POLICY

  1. Strictly no refunds after payment is made.

  2. Full refund will be given if I am unable to start the commission. Partial refund, depending on how much work is done, will be given depending on the progress of the commission.

  3. Please do not request a Paypal chargeback for a refund. I will transfer the money back to you myself.

  4. If you request for a Paypal chargeback at any point when no agreements were made about refunds/ applying for a chargeback, I will decline the chargeback and supply Paypal with our conversations/ invoice in which we talked about the commission as evidence that there was an agreement and work has been completed.
